In British Columbia, the legal documents for personal planning are:

• the Representation Agreement, and
• the Enduring Power of Attorney.

Many people will make one of each document – to cover different issues.

Some people will cover everything in a Representation Agreement.

Representation Agreement forms

There are no ready-made or off-the-shelf forms for Representation Agreements.

Form for Representation with Additional (broader) Powers

You must consult a lawyer if you want to include additional powers in your Representation Agreement. The lawyer will draft the form for you. Only a lawyer may sign a Certificate of Consultation for a Representation Agreement.

Form for Representation Agreement with Standard Powers

Nidus offers a Self-Help Course for Representation Agreements with Standard Powers. For a description of the Course, watch the video or read about it below.

 

The first steps in the Nidus Self-Help Course are:

1. Get informed and discuss with those who may be involved. The Nidus website contains lots of information. Please visit the Information and Resources Section and read the current and previous Nidus Newsletters found in News and Events Section.
2. Contact Nidus to indicate you have read/watched information and you are interested in the Self-Help Course for a Representation Agreement with Standard Powers. To contact Nidus:

Nidus does not give legal advice. Nidus will send you additional material which will help you to decide which personal planning tools are best suited to your situation.

Once you have reviewed the additional materials and determined you want to proceed, Nidus will confirm your enrollment in the course.

The Nidus Course consists of:

1. Self-Help Tutorial – information and worksheet to guide you in deciding what powers to include in the Agreement, who will be involved, and what roles they will have and how to arrange for signing and witnessing.
2. Personal appointment with Nidus Staff – an appointment by phone or in-person to answer any specific questions and to finalize the set-up for the legal form.
3. Forms for a Representation Agreement with standard powers customized to fit your situation and instructions for completing the legal forms.
4. Registration forms for registering the Agreement with the Nidus Registry.
5. Tips for using the Agreement when needed.

The cost of making a Representation Agreement through the Self-Help Course is $75. Nidus also offers a spousal rate. Nidus does not accept payment until enrollment is confirmed. Fees are subject to change.

Enduring Power of Attorney forms

Nidus does not provide forms for an Enduring Power of Attorney. Nidus provides information to help you prepare for making an Enduring Power of Attorney. Read the Nidus Fact Sheet HERE
