Duties of an Attorney
An Attorney under a Power of Attorney must act honestly and in good faith. An Attorney must keep financial records such as bills, receipts, bank statements etc. The Public Guardian and Trustee (a government official) may ask to see these records. Unless the Power of Attorney document specifies, an Attorney must not take or receive any personal benefit from acting as the Attorney. This includes taking a fee or borrowing the adult’s money. Attorneys can be reimbursed for out-of-pocket expenses. Records must be kept of these expenses and payments.
