How do I cancel or change an existing
legal Plan?
You can cancel (revoke) an enduring Power of Attorney or a Representation Agreement. The Representation Agreement Act gives specific rules for canceling a Representation Agreement, which includes putting it in writing and giving a copy to every Representative, Alternate and Monitor, named in the Agreement. To be safe, you should also register the cancellation (revocation) of your document with the Nidus Registy at www.nidus.ca This way, a document will not be misused because a bank or hospital did not know you had cancelled it. And, if you make a new Plan, register it also. For more information on canceling an existing document see the following information sheets and examples: You can also make changes to your legal document(s). The law requires that any change be signed and witnessed according to the same procedures used to create a document. In most cases, it may be just as simple to make a new document. However, making a new enduring Power of Attorney or Representation Agreement does not automatically cancel a previous one. |
